You are the compliance officer for a major corporation in New Jersey. The corporation has many unionized locations. The New Jersey location is in the far western part of the state, Warren County. You are approached by the COO at the local property to write an opinion about the various issues that may be implicated in the following set of circumstances.
In a remote area in the town of Figmento in Warren County, New Jersey, the company owns a mall with fifty stores. When the mall opened ten years ago, it damaged the local economy causing the center of Figmento to devolve into empty lots. The company not only owns the mall and rents space in 49 of the 50 store spaces but has a wholly owned subsidiary which rents the 50th store.
The Workers Retail Mall Union is trying to organize the workers in the 50th store. They begin to picket the outside of the store in the mall and the outside of the mall. Most of the workers in store 50 work in the community. In the meantime, the union has filed a ULPs for failure to recognize the new local which has a showing of interest of 40% and for interference with workers who wish to join the union.
What are the issues in this case? What approach would you take as compliance officer for the corporation?
